Terms & Conditions

1. AGREEMENT TO TERMS

By booking a service, purchasing a beat, or hiring Myan Productions LLC ("the Company"), you ("the Client") agree to be bound by these Terms and Conditions. These terms apply to all audio engineering, sound design, mixing, mastering, and video post-production services provided by the Company.

2. PAYMENT POLICY

  • Deposits: A non-refundable deposit of 50% is required to schedule or begin any custom project. Work will not commence until this deposit is verified.

  • Final Payment: The remaining balance must be paid in full before the delivery of final high-resolution files (WAV/Mastered Video).

  • Late Fees: Outstanding balances not paid within 7 days of the invoice due date may be subject to a late fee of 10%.

3. REFUND POLICY (STRICT)

  • No Refunds on Creative Services: Due to the subjective nature of creative work and the time invested, all sales are final. Myan Productions LLC does not offer refunds for mixing, mastering, sound design, or beat leases once the work has commenced.

  • Satisfaction Guarantee: We are committed to your satisfaction. If you are unhappy with a mix, we will work with you during the Revision phase to adjust it to your liking (see Section 4). Disliking a final mix is not grounds for a refund; it is grounds for a revision.

4. REVISIONS

  • Included Revisions: Each flat-rate project includes two (2) rounds of revisions at no extra cost.

  • Scope of Revisions: Revisions must be requested within 7 days of receiving the draft. Revisions include adjustments to levels, EQ, effects, or pacing.

  • Excessive Revisions: Any changes requested after the second round, or changes that require "re-doing" the production from scratch (e.g., re-recording vocals, changing the beat entirely), will be billed at our standard hourly rate.

5. INTELLECTUAL PROPERTY & USAGE

  • Work for Hire: Upon full payment, the Client is granted the non-exclusive rights to use the final mixed/mastered audio or video for their intended commercial or personal purpose.

  • Session Files: Myan Productions LLC retains ownership of the source session files (Pro Tools/Ableton sessions, project files). Delivery of these raw project files is not included in standard service rates and requires a separate "Buyout Fee."

  • Portfolio Rights: The Company reserves the right to use the Client’s final project (or snippets thereof) for promotional purposes (e.g., website portfolio, social media reels) unless a Non-Disclosure Agreement (NDA) is signed prior to the project start.

6. DELIVERY & DEADLINES

  • Turnaround Time: Estimated turnaround times are goals, not guarantees. While we strive to meet every deadline, technical issues or family emergencies may cause slight delays. We will communicate any delays immediately.

  • Client Delays: If the Client delays sending necessary files (stems, video clips, reference tracks), the project deadline will be pushed back accordingly.

7. COPYRIGHT INDEMNIFICATION & LIABILITY

  • Client Responsibility: The Client guarantees that they own or have obtained all necessary legal rights, clearances, and permissions for any audio files, samples, beats, instrumentals, or video footage they submit to Myan Productions LLC.

  • Uncleared Samples: Myan Productions LLC is not responsible for clearing samples or verifying copyright ownership. If the Client provides materials that contain unauthorized samples or copyrighted works, the Client assumes full legal responsibility.

  • Indemnification: The Client agrees to indemnify, defend, and hold harmless Myan Productions LLC and Mitchell Ryan Siriano from any and all claims, lawsuits, damages, or legal fees resulting from copyright infringement allegations regarding materials provided by the Client. In plain English: If you get sued because of a sample or beat you gave us, you agree to pay our legal costs and leave us out of it.

  • Limitation of Liability: To the maximum extent permitted by Connecticut law, Myan Productions LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Total liability shall be limited strictly to the amount paid by the Client for the specific project.

8. GOVERNING LAW These Terms shall be governed by and defined following the laws of the State of Connecticut. Myan Productions LLC and the Client consent that any legal proceedings regarding these terms will be resolved in the courts of Fairfield County, Connecticut.
